A trademark suit filed by The Kroger Co. accusing new-to-the-U.S. grocer Lidl of copying its "private selection" generic brand name and logo has been dismissed.

The two sides agreed last week to dismiss the federal case with prejudice. Each side will pay their own legal costs, according to court filings.

Kroger, which also owns Harris Teeter, had filed the suit in Richmond, where the number of grocer competitors have exploded with the arrival of Lidl, Wegmans and, soon, Publix.
