Palm Beach, FL — We've heard of "smear campaigns," but a recent lawsuit filed by Delray Beach-based Original Brooklyn Water Bagel Co. against one of its former founders, Donald Kurtzer and the Famous New York Baking Water Corp., might more aptly be deemed a "schmear campaign." The case, filed on May 14, 2010 in Palm Beach County, Florida by the bagel company (Case #502010CA013084XXXXMB), states that the Famous New York Baking Water Corp. has been infringing on it's "trade secret."
According to an article posted May 20, 2010 on Courthouse News Service, the bagel company claims that Kurtzer and the Famous New York Baking Water Corp. stole the bagel company's "14-step process that gives local tap water 'the quality and characteristics' of Brooklyn tap water." The article states that, "the bagel company claims that Kurtzer infringed on its trademarks and violated his confidentiality agreement."
Kurtzer, however, says the allegations are completely without merit and is looking forward to challenging them in court.
"This case has more holes than the company's bagels," Kurtzer says. In response to the allegations made by the bagel company, Kurtzer says his company did everything in accordance with the law and points out the following:
• No trade secrets were stolen from the bagel company or anyone else.
• There was never a confidentiality agreement or non-compete clause with any of the original founders of the water system and bagel company.
• The plaintiff's claims against Kurtzer coincide with other misrepresentations he previously made, and are documented in Dade County Circuit Court and Palm Beach County Court civil records. These claims are related to Wolfie's in Aventura, and Deli Express in Delray Beach, both restaurants which the plaintiff was previously involved in.
• The bagel company claims they invented the water for their bagels, when in fact Howard Sackel, one of the original three founders, is the one who researched and identified the water characteristics. Sackel shared this information with Kurtzer well before the bagel company ever existed.
• Published media stories also show inconsistencies by the bagel company.
Kurtzer says this is nothing more than a personal attack on him, and a way for the bagel company owner to try and prevent him from successfully selling the water system.
"The business plans of these two companies are extremely different," Kurtzer says. "They are selling bagel franchises and we are selling a water filtration system that spans way beyond bagels and can be used for pizzas, breads and much more. I look forward to fighting this battle legally in court and prevailing."
