A Wisconsin law that requires all butter sold in the state to be graded has been upheld by the Seventh Circuit Court of Appeals, rejecting an artisanal butter maker’s argument that the government has no right to set flavor standards.
Ohio-based Minerva Dairy, which claims to be the nation’s oldest family-owned butter maker, had been selling butter in Wisconsin until a complaint prompted state inspectors to stop the sales unless the butter was graded.
Minerva claimed the Wisconsin requirement was mere protectionism and an illegal interference with interstate commerce.
