General Mills' Yoplait Greek Yogurt Fraud Lawsuit Sent To FDA

A federal judge will let the U.S. Food & Drug Administration decide whether General Mills Inc. may label its Yoplait Greek yogurt with the words "Greek" and "yogurt."

U.S. District Judge Susan Nelson on Monday dismissed a federal lawsuit by a consumer who accused Golden Valley-based General Mills (NYSE: GIS) of defrauding customers. She directed both sides to take their dispute to the FDA.

The suit alleged that General Mills knowingly mislabeled the yogurt as yogurt, even though it includes milk protein concentrate (MPC), which is not listed by the FDA among acceptable yogurt ingredients. (MPC is the ultra-filtered, dry milk powder that prevents Kraft Foods Inc. from calling Velveeta "cheese.")
