Lawsuit: Giant Eagle Told Developer It 'Cannot Allow' New Whole Foods Store

The team working to redevelop the former Consol Energy Inc. headquarters in the South Hills has sued an Upper St. Clair resident protesting the plan, accusing her of working at the behest of Giant Eagle to keep out a proposed Whole Foods Market, according to court documents.

In the action filed May 9 in the Court of Common Pleas of Allegheny County, 1800 Washington Road Associates LP sued Moira Cain-Mannix, an Upper St. Clair resident and lawyer with Marcus & Shapira, a firm whose managing principal is a member of the Shapira family, majority owners of Giant Eagle.

The suit comes as the development firm has been working for more than three years to redevelop the 28-acre property at 1800 Washington Road — across from South Hills Village — into a new project called Siena, which is to include a mix of uses anchored by the new Whole Foods. A lease commitment for the Upper St. Clair Whole Foods was announced in November 2012.
